HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 6270 of 2025 Court No. - 17 HON'BLE SUBHASH VIDYARTHI, J.
1. Heard Sri Ashish Kumar Gupta, the learned counsel for the petitioner and perused the records.
2. By means of the instant petition filed under Article 227 of the Constitution of India the petitioner has assailed the validity of an
order dated 07.10.2025, passed by learned District Judge, Ayodhya in Misc. Civil Appeal No.74 of 2025: Surendra Pandey Vs. Dhanesh Kumar and others, whereby the District Judge has
directed the parties to maintain status-quo till the next date of listing.
3. The learned counsel for the petitioner has submitted that the aforesaid order has been passed without giving opportunity of hearing to the petitioner, although the petitioner had filed a caveat.
4. A bare perusal of the order dated 07.10.2025 indicates that it is recorded therein that the
learned counsel for the caveator/respondent no.2 was present and he was heard by the District Judge.
5. It is settled law that narration regarding happenings in the court recorded in any order has to be presumed to be correct. In case litigant intends to challenge the correctness of the same, he can do so by filing an application before the same court and not before any higher court. Versus Counsel for Petitioner(s) : Ashish Kumar Gupta Counsel for Respondent(s) :
Ashok Kumar .....Petitioner(s) Surendra Kumar Pandey And Another .....Respondent(s)
6. The learned counsel for the petitioner next submitted that it is recorded in the impugned order that the interim order will not be extended in case the appellant fails to take steps, although the
order has been extended.
7. Admittedly, the petitioner has not filed any application for vacation of the temporary injunction order granted by the appellate court. The appeal is still pending consideration.
8. In these circumstances, there is no good ground to make any interference in this petition.
9. Accordingly, writ petition is disposed of leaving it open to the petitioner to appear before the learned appellate court and file a suitable application for vacation of interim order/early disposal of the appeal, which shall be considered and decided by the learned court in accordance with law without granting any unnecessary adjournments to any of the parties.
