HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 10295 of 2025 Court No. - 3 HON'BLE SHEKHAR B. SARAF, J.
HON'BLE PRASHANT KUMAR, J.
1. Heard learned counsel appearing on behalf of the parties.
2. As per the report of the Director (Security), the D.J. set had a height of twelve feet and included a pole measuring two meters, making the total height eighteen feet. However, as per policy, the minimum sag height of the electric wire should be 6.1 meters above the ground, which is equivalent to twenty feet. In this case, the combined height of the D.J. set and the pole was eighteen feet, while the required sag height was twenty feet. Had the sag been at the prescribed height of twenty feet, no incident of electrocution would have occurred. Since the sag was lower than the required level, the petitioner's son unfortunately died due to electrocution.
3. In light of the same, the impugned orders are quashed and set aside.
4. Accordingly, the respondent-authority is directed to reconsider the matter of the petitioner and pass a reasoned order in accordance with law within a period of six weeks from date after granting an opportunity of hearing to the petitioner.
5. With the above direction, the writ petition stands disposed of.
