The present application has been filed for the following main relief:- "WHEREFORE, it is most respectfully prayed that the Judgment and order, dated 05.01.2024, passed by the Court of Chief Judicial Magistrate, Sitapur passed in Complaint No.- 1121/2019 (M/S Shree Ram Seeds Through Proprietor Chhama Rastogi, Village Arjanpur, Police Station- Khairabad, Tehsil and District Sitapur v. S.K. Singh, Authorised Signatory of M/S National Agro Seeds Corporation and Durga Agro, Daliganj, Faizabad Road, Lucknow), under Section 138 N.I. Act, Police Station- Kotwali, Sitapur where Respondent was acquitted may kindly be quashed/set-aside and Respondent may kindly be convicted for offence under section 138 N.I. Act." 3. On being opposed based upon the judgment passed by the Hon'ble Apex Court in the case of M/s. Celestium Financial v. A. Gnanasekaran etc., 2025 SCC OnLine SC 1320, learned Counsel for the applicant says that he does not want to press the present application and the same may be dismissed as withdrawn with liberty to the applicant Versus Counsel for Applicant(s) : Nadeem Murtaza, Arun Kumar Pamdey, Priyanka Tripathi, Suresh Chandra Pandey, Wali Nawaz Khan, Yash Pandey Counsel for Opposite Party(s) : Brijesh Kumar Singh M/S Shree Ram Seeds Thru.
