Accused in Crime No.2/2025 registered by Whitefield Police Station, Bengaluru City, for the offences punishable under Section 75(2) of BNS, 2023 and Sections 8 and 12 of the POCSO Act, 2012, is before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.2/2025 was registered by Whitefield Police Station, Bengaluru City, against petitioner herein for the aforesaid offences based on the first information dated 02.01.2025 submitted by cousin sister of the victim girl. During the course of investigation, petitioner was arrested on 02.01.2025. Bail application filed by him before the jurisdictional Sessions Court in Crl.Misc.No.70/2025 was rejected on 05.02.2025. Therefore, he is before this Court. 4. Learned counsel for the petitioner having reiterated the grounds urged in the petition has prayed to allow the petition. - 3 - NC: 2025:KHC:10958 CRL.P No. 2337 of 2025 5. Per contra, learned HCGP has opposed the petition. Learned counsel for respondent No.2 submits that he has no objection to allow the petition. 6. Petitioner is in custody in the present case from 02.01.2025. The maximum punishment for the alleged offences is imprisonment for a period of five years. Investigation in the case is completed and charge sheet has been filed. It is not in dispute that petitioner has no other criminal antecedents. Learned counsel for respondent No.2 has submitted that he has no objection for grant of regular bail to the petitioner and he also submits that based on the statement made by an acquaintance, first informant had approached the police. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made in the petition needs to be answered affirmatively. Accordingly, the following order:- 7. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.2/2025 registered by Whitefield Police Station, Bengaluru City, for the offences punishable under Section 75(2) of BNS, 2023 and Sections 8 and 12 of the POCSO Act, 2012, subject to the following conditions: - 4 - NC: 2025:KHC:10958 CRL.P No. 2337 of 2025 a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
