HON'BLE ZAFEER AHMAD, J. 1.Heard Sri Vimal Kishore Singh, learned counsel for the petitioner and learned A.G.A. 2. This petition has been filed with the following main relief:- Issue a writ in nature of the Mandamus commanding and directing the Opposite Party No. 02 and 03 to not harass and torture the petitioner and his wife, in the interest of justice. 3. Learned counsel for the petitioner submits that on account of matrimonial dispute between the son and daughter-in-law of the petitioner an application under Section 125 Cr.P.C. was filed in which the family court had directed for payment of maintenance and in connection with the recovery of maintenance, the petitioner is being harassed, whereas the son of the petitioner is not residing with the petitioner and he is living separately. 4. Learned A.G.A. on the basis of instructions dated 01.11.2023 received from Sri Prabhu Narayan Pal, Sub Inspector, Police Station Sandila, District Hardoi submits that the petitioner was contacted in connection with the recovery of the order passed under Section 125 Cr.P.C.in Case Crime No.322 of 2013 from son of the petitioner to know whereabouts of his son only and he is not being harassed, therefore, the writ petition has been filed on the basis of misconceived and baseless ground. 5. In view of above, the writ petition is disposed of in terms of statement made by learned A.G.A. on the basis of instructions.
