Counsel submits that permission has been granted to the respondent No.3 by the Jaipur Municipal Corporation contrary to the directions issued by the Division Bench of this Court in the case of Gulab Kothari, Editor, Rajasthan Patrika, Jaipur vs. State of Rajasthan and Others while deciding D.B. Civil Writ Petition No.1554/2004. Counsel submits that as per the directions passed in the aforesaid judgment, no multistory building (2 of 2) [CW-6786/2025] can be allowed to be constructed, but in violation of aforesaid directions, permission has been granted. Counsel submits that several complaints in this regard have been submitted before the authority in the year 2024, but in-spite of passing of considerable time, till date, no action has been taken, hence, under these circumstances, interference of this Court is warranted. 2. In the considered opinion of this Court, when a complaint is filed by a person aggrieved before the competent authority, it is expected from the authority concerned to decide the said complaint by passing a reasoned and speaking order. The authorities cannot be allowed to sit over the matter. 3. This Court deems it just and proper to dispose of the instant writ petition by issuing directions to the respondents to decide the complaint/representation submitted by the petitioners expeditiously as early as possible, preferably within a period of one month from the date of receipt of certified copy of this order, after providing due opportunity of hearing to the respondent No.3. 4. Needless to observe that the respondents would pass reasoned and speaking order. 5. Before parting with this order, it is made clear that this Court has not issued any direction to the respondents to decide the representation in a particular way. It is expected from them to decide the same strictly in accordance with law. 6. They stay application and all pending applications, if any, also stand disposed of. (ANOOP KUMAR DHAND),J KuD/363
