Baruah, learned Additional Public Prosecutor for the State. 2. This application under Section 482 of BNSS, 2023 has been filed by the petitioner, namely, 1. Sahel Uddin, has prayed for grant of bail in connection with Karimganj P.S Case No.296/2025 under Section 108 of BNS, 2023. 3. The learned counsel for the petitioner submits that the accused petitioner was arrested on 19.06.2025 and has been in under trial detention since then. 4. The case arose out of an ejahar dated 19.06.2025, lodged by the brother of the deceased alleging that the accused had a love affair with his sister by considering on aspect of his identity and subsequently, upon coming to know of his real identity, the victim tried to stop the relationship but the accused kept insisting and eventually, she committed suicide on 18.06.2025. 5. Mr. HRA Choudhury, learned senior counsel for the petitioner submits that the accused may be granted default bail, if final form not yet submitted in the meantime. 6. The learned Additional Public Prosecutor for the State fairly submits that, upon taking instructions from the I.O, it came to be known that investigation is still in progress. 7. In the said situation as the accused was arrested on 19.06.2025 and has completed 60 days in under trial detention, he can be granted bail as investigation is not completed and applicable statutory period is 60 days. Accordingly, the above-named accused is allowed to go on bail of Rs.20,000/- (Rupees Twenty Thousand) only with one surety of like amount subject to the satisfaction of the concerned learned court with following conditions: i) That the petitioner shall co-operate with the remaining investigation; ii) That the petitioner shall not hamper or tamper any evidence. 9. Violation of bail conditions might entail cancellation of the bail. 10. With the above observations, this bail petition stands allowed and stands disposed of with the aforesaid terms.
