Heard Ms. Navya Srivastava, learned counsel appearing on behalf of the petitioner and learned Standing Counsel appearing on behalf of the State. 2. This is a writ petition under Article 226 of the Constitution of India, wherein the writ petitioner has made the following main prayers:- "i. Issue a writ, order or direction in the nature of Mandamus commanding the opposite party no. 3 (Sub-Divisional Magistrate, Purwa) to grant necessary permission to the petitioner for boring and installation of a domestic handpump for drinking water within the campus/ boundary of his ancestral House No 63 Ahata No. - 65, situated at Village Chaupai, Post Chaupai, Block Asoha, Tehsil Purwa, District Unnao. ii. Issue a writ, order or direction commanding the opposite parties to ensure the drinking water for the petitioner and his family members as guaranteed under Article 21 of the Constitution of India. iii. Issue a writ, order or direction in the nature of Mandamus directing the opposite party no. 2 and 3 to decide the application dated 03.10.2025 so that petitioner is allowed to install the domestic handpump in his house/ premises." 3. Upon hearing learned counsel appearing on behalf of the parties, it Versus Counsel for Petitioner(s) : Parul Gupta Counsel for Respondent(s) : C.S.C. Rajaram .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Rural Development Deptt. Lko. And 3 Others .....Respondent(s) appears that the petitioner is carrying out boring and installation of a domestic handpump for drinking water within the campus of his ancestral home. 4. In light of the same, we direct the authorities not to interfere in the said construction unless there is any impediment in law against the petitioner installing the domestic handpump. 5.
