----------- For the Petitioner : None For the Respondents : Mr. Binit Chandra, Advocate
---------- 07/ 03.07.2025 The petitioner-society by way of present writ application has prayed for a direction upon the respondents to give effect to the recommendation by 5th PRC which has been adopted by the erstwhile State of Bihar vide resolution dated 17.02.1999 w.e.f. 01.01.1996 read with Annexure-III of the recommendations of the fitment committee to the teaching and non-teaching employees working in the State Recognized Minority Secondary Schools in South Chhotanagpur Division of the State of Jharkhand and whose services have been duly approved by the competent authority of the State. created State of Jharkhand under the Chairmanship of the Hon’ble Chief Minister on 16.09.2002 wherein a decision was taken not to implement the Central Pay Scale (6th Revised Pay Scale) in the case of these petitioners. 7. That it is humbly submitted and stated that earlier the benefit of revised pay-scale has been given to these petitioners on two occasions i.e. with effect from 01.04.1981 and 01.01.1986. 8. That it is humbly submitted and stated that the Govt. provides grant-in-aid to run the schools.
The minority schools are basically Society run schools, which have been recognized by the Government and thus whatever monetary help is provided by the Govt. is a sort of aid to the school and thus this matter to implement 6th Pay Revision cannot be treated as claim of the teachers or the school but they can plead to enhance the aid, which has to be decided by the Government as per its financial condition and budgetary provisions.”
3. Mr. Binit Chandra, learned counsel appearing for the respondents fairly submits that the instant application may be disposed of by giving liberty to the affected employees that if any affected employee is interested in their claim, then they may approach the concerned respondents with regard to the prayer made by the petitioner-Society. 4. Having regard to the submissions made by the learned counsel for the respondents and since none is appearing on behalf of the petitioner, the instant writ application is hereby disposed of by giving liberty to the members of the Society that if at all they are still having any grievance, then they may approach the concerned respondents. 5. Accordingly, the instant writ application stands disposed of. (Deepak Roshan, J.) kunal/-
