1. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record. Despite service of notice, no one appeared on behalf of the complainant. The counter affidavit filed by the State is taken on record. 2. The applicant seeks enlargement on bail in FIR No.172 of 2025, under Sections 64(1), 352, 115(2) of BNSS and Section 3/4 of POCSO Act, Police Station Khodare, District Gonda. 3. In terms of the FIR, it was alleged that the daughter of the informant aged about 16 years was in the agricultural fied and the applicant caught hold with her and misbehaved with her and also forced her to come with him. In the statement under Section 180 of BNSS, a similar statement was given and no allegation of rape was levelled, however, in the statement under Section 183 of BNSs, the allegation of rape was also levelled. The medical report does not corroborate the allegation. The tentative age of the victim is around 17 years and six months. 4. Learned A.G.A. vehemently opposed the bail prayer. 5. Considering the huge inconsistencies in the FIR version and the two statement of the victim and the medical report not corroborating the allegations and the fact that the applicant has no criminal antecedents and is languishing in jail since 02.07.2025, I am of the view that the applicant Versus Counsel for Applicant(s) : Amitesh Pratap Singh Counsel for Opposite Party(s) : G.A.
