The joint memo signed by the learned counsel for the petitioner and respondent is present. The joint memo reads as under: "JOINT MEMO" "The award dated 16.8.2013 in I D R 11/2010 passed by the Labour Court, Chikmagalur (Annexure H) may kindly be modified as under: "The corporation to pay the Petitioner terminal benefits till the date of superannuation by considering continuity of service from the date of dismissal till the date of superannuation for purposes of terminal benefits only. The Petitioner is not entitled for backwages as also consequential benefits from the date of dismissal till the date of superannuation." The parties to the proceedings have agreed for the above terms." 2. It is noticed that the petitioner has attained the age of superannuation as such, he is entitled to - 3 - NC: 2025:KHC:8853 WP No. 10358 of 2014 the benefits agreed to be paid in terms of the joint memo. 3. The benefits agreed to be paid within two months from the date of this order. 4. The impugned order is substituted in terms of the joint memo. Writ petition is disposed of accordingly.
