The present writ petition has been preferred with the prayer to direct the Commissioner, Basti Mandal, Basti to decide the case no. 129 of 2025 , Computerised No.C202517000000129 (Amar Jit Yadav Vs. Additional District Magistrate (Judicial), Sant Kabir Nagar and another) under section 6 of the U.P. Control of Goondas Act, 1970 filed on 20.1.2025 arising out of order dated 9.12.2024 passed by Additional District Magistrate (Judicial), Sant Kabir Nagar in case no. 161 of 2022, Computer Case No.D202217650000161(State vs. Amar Jit Yadav) under section 3/4 of U.P. Control of Goondas Act, 1970, within a fixed time frame. Learned counsel for the petitioner submits that his stay application is pending in Appeal no. 129 of 2025 pending before the respondent no.2, Commissioner, Basti Mandal, Basti preferred under section 6 of the U.P. Control of Goondas Act, 1970. The writ petition is disposed of directing the respondent no.2, Commissioner, Basti Mandal, Basti to decide the appeal within a period of six weeks from the date of production of certified copy of the order. Till the appeal is decided by respondent no.2, Commissioner, Basti Mandal, Basti, the operation of the order dated 9.12.2024, passed by Additional District Magistrate (Judicial), Sant Kabir Nagar in case no. 161 of 2022 under section 3/4 of U.P. Control of Goondas Act, 1970 shall remain stayed.
