Accused No.2 in Crime No.3/2025 registered by Subramanyanagar Police Station, Bengaluru, for the offences punishable under Sections 109 (1), 126 (2), 115 (2), 352 read with Section 3(5) of BNS, 2023, is before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.3/2025 was registered by Subramanyanagar Police Station, Bengaluru, for the aforesaid offences against three unknown persons on the basis of the first information dated 09.01.2025 received from Bharath N, S/o late Narasimha Murthy H.K. During the course of investigation, petitioner herein was arrested on 31.01.2025 and subsequently, remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.1018/2025 was rejected on 12.02.2025. A perusal of the material on record would go to show that the incident in question had taken place outside a pub after the two wheeler which the injured was riding came in front of a maruti swift car in which accused Nos.1 to 3 were traveling. For the reason that first informant had come in front of their car, accused persons who were inside the car allegedly got down from the car and after abusing the petitioner, they had assaulted him. Accused Nos.2 and 3 allegedly had initially assaulted the first informant with their hands. The allegation of assaulting the injured first informant with a weapon and thereafter dashing him with the car are all found as against accused No.1, who is in custody. It is not in dispute that petitioner has no other criminal antecedents. Considering the nature of allegations found as against him and since he has no other criminal antecedents, I am of the opinion that his prayer for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:- 5. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.3/2025 registered by Subramanyanagar Police Station, Bengaluru, for the offences punishable under Sections 109 (1), 126 (2), 115 (2), 352 read - 4 - NC: 2025:KHC:9230 CRL.P No. 2248 of 2025 with Section 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
