This is an application under Section 482 of BNSS, 2023, praying for grant of pre- arrest bail to the accused applicant, namely, Smti. Leena Gowala, who is
Page No.# 2/3 apprehending her arrest in connection with Makum P.S. Case No. 36/2025 registered under Section 105 of the BNS, 2023, corresponding to G.R. No. 573/2025. 3. The gist of the allegation as has been narrated in the FIR is that the accused applicant, who is the Headmistress of Nagaon High School, Makum had engaged four students studying at Class-X in the said school to cut the branches of a tree and in the process of such cutting, one of the students, namely, Rajiv Kurmi fell down and sustained grievous injury and later on died in the hospital. 4. Learned counsel for the accused applicant submits that this Court by order dated 14.08.2025 had granted interim pre-arrest bail to the accused applicant, who is the Headmistress of Nagaon High School, Makum. Accordingly, the accused applicant had appeared before the investigating authority and had her statements recorded by the investigating authority. He further submits that the accused applicant has been co- operating with the investigation and has not flouted any of the conditions of the interim pre-arrest bail. 5. Learned APP, Assam for the State submits that he has received the case diary and there are materials regarding the involvement of the accused applicant in the offence. He submits that being a Headmistress of a school she should not have engaged the students in such activities of cutting down branches of trees and thereby, she has committed the offence punishable under the BNS, 2023. 6. This Court has perused the case diary and has also heard the submissions of the respective parties. 7.
After perusal of the case diary and considering the submissions of the parties, this Court is of the considered opinion that this pre-arrest bail application merits interference by this Court and therefore, the interim pre-arrest bail granted to the accused applicant vide order dated 14.08.2025 is hereby made absolute, with the same terms and conditions as provided in the aforesaid order.
