Learned Counsel for the petitioners and Learned Senior Counsel for the State are present.
2. The present writ petition has been filed for directing the respondent authorities to pay the compensation/compromise for the land acquired for the Rail Corridor project in between Sasaram and Mughalsarai. Further,
Patna High Court CWJC No.11489 of 2018(4) dt.28-01-2025 2/2 the petitioner seeks a direction to the Land Acquisition Officer- cum- Competent Authority to refund the compensation amount paid to the private respondent, along with other relief/reliefs.
3. Learned Counsel for the petitioners submits that the petitioners are the bona fide purchaser of the land from the vendor, namely, Mr. Dharmendra Kumar Pathak (petitioner No. 4), to whom the original landowner executed a Will.
4. Learned Counsel for the State submits that a title suit No. 257 of 1995, is pending for determination of title for the land in dispute, and till date the petitioners are not the title holder.
5. As such, this writ petition is disposed off without saying anything on the merit or demerit of this case, granting liberty to the petitioner that, after the finality of title suit No. 257 of 1995, if cause of action arises, the petitioners shall be at liberty to sue in accordance with the law.
