Siddiq For Dass & Viswa for R8 ORDER This writ petition has been filed for a Mandamus seeking for a direction to the respondents 1 to 4 to restore the Nilavial Padhai running through the property, morefully described in the prayer to this writ petition. 2.According to the petitioner, the main contesting respondents are 7 to 9, who are obstructing the usage of the Nilavial pathai by the petitioner and others. The petitioner seeks for restoration of the Nilavial pathai. 3.Learned Special Government Pleader appearing for the respondents 1 to 4 would submit that the respondents 1 to 4 are willing to hold an enquiry amongst the petitioner and the contesting private respondents as well as any other third party who is having an interest in the Nilavial pathai and thereafter, pass final orders on the petitioner's representation, on merits and in accordance with law within a time frame to be fixed by this Court. https://www.mhc.tn.gov.in/judis
WP No. 41375 of 2025 4.Learned counsel for the eighth respondent submits that the eighth respondent is dead. 5.Learned counsel for the respondents 7 and 9 also stated no objection if such a direction is issued by this Court. However, necessarily, the third respondent Tahsildar has to hear objections from the legal representatives of the deceased eighth respondent also by putting them on notice.
6.For the foregoing reasons, this writ petition is disposed of by directing the third respondent to conduct an enquiry by giving notice to the petitioner as well as the private respondents i.e. respondents 7 & 9 as well as the legal representatives of the eighth respondent and any other third party, whom the third respondent deems fit to enquire with regard to the request of the petitioner made through his representation dated 26.07.2025 seeking for restoration of the Nilavial padhai running through the property, morefully described in the prayer to this writ petition within a period of 12 weeks from the date of receipt of a copy of this order.
