PUBLIC PROSECUTOR 2 The Court made the following ORDER: The present Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, by the petitioner for granting of anticipatory bail in connection with Crime No.103 of 2025 on the file of the Gudlavalleru Police Station, Krishna District, registered for the alleged offences punishable under Sections 132, 351 (2) of Bharatiya Nyaya Sanhita, 2023. 2. Learned counsel for the petitioner would submit that the offences alleged are punishable with imprisonment up to 7 years and prays this Court to direct the police to follow the procedure contemplated under Section 35(3) of BNSS, 2023. 3. On the other hand, learned Assistant Public Prosecutor, while opposing the criminal petition stated that the offences are punishable less than 7 years of imprisonment. 4. Having considered the submissions made by the learned counsel on record, this Court feels that it is appropriate to dispose of the Criminal Petition by directing the respondents to strictly follow the procedure contemplated under Section 35 (3) of BNSS, 2023, as per the guidelines enunciated in 1Arnesh Kumar Vs.
