Neutral Citation No. - 2025:AHC:20491 Court No. - 10 Case :- WRIT - A No. - 1791 of 2025 Petitioner :- Neeraj Singh Respondent :- Indian Institute Of Technology Kanpur And Another Counsel for Petitioner :- Priyansh,Sr. Advocate Counsel for Respondent :- Rohan Gupta Hon'ble Saurabh Shyam Shamshery,J. 1. Heard Sri Sanjeev Singh, learned Senior Advocate assisted by Sri Pryansh, learned counsel for petitioner and Ms. Kriti Gupta, Advocate holding brief of Sri Rohan Gupta, learned counsel for respondents. 2. The fact that petitioner was appointed by appointment letter dated 06.06.2024 on the post of Junior Assistant and he has not been appointed till date is not under dispute. 3. Learned Senior Advocate appearing for petitioner refers the documents annexed alongwith this writ petition that on one hand petitioner is denied to join concerned post but on other hand respondents have now proceeded to commence fresh selection process which may include backlog post including the post on which petitioner was appointed. 4. Learned counsel appearing for respondents submits that post on which petitioner is appointed is not the part of fresh recruitment process. On basis of instruction, she further submits that there is certain dispute with regard to experience certificate of petitioner as well as that one Pranav Kumar has filed a writ petition being Writ- A No. 11770 of 2024 wherein earlier selection process is under challenge and petitioner therein is claiming appointment on concerned post. However, it is not dispute that there is no interim order in that writ petition. Counsel for respondents further submits that legal impediment, if any, will be communicated to petitioner within a very short period. 5. I have considered the above submissions. It is not disputed that no reason has been communicated to petitioner till date why there is delay in his joining on concerned post, on which he was appointed on 06.06.2024. It appears that there is no legal impediment so far as pendency of other writ petition is concerned. Therefore, this writ petition is disposed of with observation that in case legal impediment, if any, in joining of petitioner, is not communicated to him within three weeks from today, respondents are directed to permit petitioner to join the concerned post, subject to any order passed in above writ petition, i.e., Writ-A No. 11770 of 2024. 6. A copy of this order be placed on records of Writ-A No. 11770 of 2024. 7. Registrar (Compliance) to take steps.
