Also heard Mr. G. Bokolial, learned Government Advocate appearing for all the respondents. 2. The petitioner is the owner of vehicles bearing Registration Nos. AS-01-BY- 4577 (Gypsy), AS-23-AC-1969 (Mini Bus), AS-25-Q-2028 (Gypsy), AS-25-Q- 2031 (Gypsy), AS-01-EC-2271 (Mini Bus), AS-01-HC-3439 (Mini Bus), AS-06-A- 4022 (Gypsy), AS-01-F-9650 (Gypsy), AS-01-BY-4630 (Gypsy), AS-14-L-1733 (Gypsy), AS-15-C-8450 (Mini Bus), AS-25-Q-2712 (Gypsy) & AS-09-E-9613 (Gypsy) respectively, which were hired by the respondents on different dates in Page No.# 3/9 the year 2015 to 2024 for maintaining law and order situation. The petitioner thereafter submitted his bill amounting to Rs.2,03,58,955/- on account of the hiring charges of the petitioner’s vehicles before the respondent authorities. However, till date, the petitioner is yet to receive any amount and accordingly, the present writ petition. 3. The respondent No. 6, i.e. the Deputy Commissioner of Police (Administration) has filed an affidavit and in Paragraph Nos. 4 & 5, it is stated as under: “4. That with regard to the statement made in paragraph - 3 of the Writ Petition, the answering deponent begs to state that the vehicles No. (1) AS-01-BY-4577 (Gypsy), (2) AS- 23-AC-1969 (Mini Bus), (3) AS-25-Q-2028 (Gypsy), (4) AS-25-Q-2031 (Gypsy), (5) AS-01-EC- 2271 (Mini Bus) (6) AS-01-HC-3439 (Mini Bus) (7) AS-06-A-4022 (Gypsy) (8) AS-01-F-9650 (Gypsy) (9) AS-01-BY-4630 (Gypsy) (10) AS-14-L-1733 (Gypsy) (11) AS-15-C-8450 (Mini Bus) (12) AS-25-Q-2712 (Gypsy) and (13) AS-09-E-9613 (Gypsy) were hired as per the records available for the purposed of maintenance of law and order duty under the provisions of the Assam Requisition and Control of Vehicles Act, 1968. 5. That with regard to the statements made in paragraph - 4 & 5 of the writ petition, the answering deponent begs to state that the petitioner has claimed bills amounting to Rs. 2,03,58,955/- on account of hire charges of the vehicles belongs to him. Considering the claim made by the petitioner in the instant writ petition, the available records were verified and found that petitioner has submitted 108 No's of hire charge bills on various dates for the period from 01.01.2016 to 31.03.2024 as per the rate fixed by the Govt. of Assam, Transport Department time to time. It is stated that out of 108 No's of hire charge bills, 99 No's of bills have already been checked and verified with the available records and after completion of verification and observing the formalities required for the purpose of submitting proposal to the sanctioning authority. Accordingly, 7 No's of proposal vide (1) No. 5725-5751 (RV) dated 30.10.2024 containing 27 No's of bills (2) No. 5752-5763 (RV) dated 30.10.2024 containing 12 No's of bills (3) No. 5774-5786 (RV) dated 02.11.2024 containing 13 No's of bills (4) No. Page No.# 4/9 5787-5803 (RV) dated 02.11.2024 containing 17 No's of bills (5) No. 5816-5828 (RV) dated 02.11.2024 containing 13 No's of bills (6) No. 5829-5840 (RV) dated 08.11.2024 containing 12 No's of bills and (7) 5841-5845 (RV) dated 08.11.2024 containing 5 No's of bills, total amounting to Rs. 1,95,39,673/- have already been forwarded to the sanctioning authority i.e. the Assistant Inspector General of Police (Admn), Office of the Director General of Police, Assam, Ulubari, Guwahati for according sanction and allotment of the fund required to credit the same to the Bank Account of the petitioner. However, steps will be taken after re-examination with the concerned records. It is further stated that the matter relating to the release of hire charges claim amount always depend on the approval of sanction as well as allotment of fund required from the Sanctioning Authority. However, the required sanction and allotment of fund against the above noted 7 (seven) No's proposals are yet to be received. Once sanction as well as allotment of fund received, steps will be taken to credit the amount to the bank account of the petitioner maintained in the concerned bank.” 4. Considering the averments made in the Paragraph Nos. 4 & 5 of the affidavit-in-opposition filed by the respondent No. 6, this writ petition is disposed of directing the respondents to have a verification with regard to the Page No.# 9/9 claim of the petitioner for his outstanding bills amounting to Rs.2,03,58,955/-. Thereafter, on verification, if the claim of the petitioner is found to be admitted, the same shall be paid to the petitioner within a period of 4 (four) months from the date of receipt of a certified true copy of this order. 5.
