HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 12266 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant and learned State counsel as well as perused the records. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 376 of 2025, under Section 2(B)(i)/3 of the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986, registered at Police Station Neemgaon, District Lakhimpur Kheri. The gang chart mentions involvement of the applicant in a solitary case, in which he has been granted bail. The applicant is said to be involved in one other case, in which he has been granted bail by learned Sessions Judge. The copies of bail orders have been annexed collectively as Annexure-4 to the bail application. It has been stated that the applicant is innocent, he has been falsely implicated in the present case, and is languishing in jail since
20.11.2025. It is further submitted that co-accused Atal Bajpai and Suraj have already been granted bail vide order dated 25.9.2025 passed in Bail Application no.9303 of 2025 by coordinate Bench of this Court. The applicant seeks parity with the bail order of the said co-accused. The learned A.G.A. has opposed the prayer for bail and has Versus Counsel for Applicant(s) : Surendra Kumar Mishra Counsel for Opposite Party(s) : G.A. Satyam Dixit @ Satyam .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Deptt. U.P. Lko. .....Opposite Party(s)
submitted that the investigation is still going on. Prima facie, it appears that the applicant has been implicated in the present case merely on account of his criminal history. There appears to be no reasonable ground for believing, at this stage, that the applicant is guilty of the offence alleged. The minimum punishment which can be imposed in case of the applicant's conviction is imprisonment for two years. There is nothing on record which may give rise to a reasonable apprehension that the applicant may tamper with the evidence or influence the witnesses, or that the applicant will abscond and not face the trial, or that he is likely to commit any other offence in case he is released on bail.
On due consideration of the fact that the applicant has been languishing in jail since 20.11.2025; that even the investigation has not been concluded; and considering the ground of parity with the bail
order of the co-accused, without expressing any opinion on the merits of the case, this Court is of the view that the applicant is entitled to be released on bail.
Accordingly, the bail application is allowed.
Let the applicant–Satyam Dixit alias Satyam be released on bail in the case registered under the Uttar Pradesh Gangsters and Anti- Social Activities (Prevention) Act, 1986, on his furnishing a personal bond and two reliable sureties each of the like amount to the satisfaction of the Magistrate/Court concerned, subject to the following conditions:- (i) The applicants will not tamper with the evidence during the trial.
