2. In this petition, under Article 226 of the Constitution of India, the petitioner has prayed for issuing direction to the respondents to allot the Unified District Information System for Education (UDISE) Code in favour of the petitioner's school in terms of the recommendation made by the District Level Redressal Committee, Baksa and consequential order, dated 10.07.2024, issued by the District Commissioner, Baksa. 3. Mr.
Islam, learned counsel for the petitioner, submits that the petitioner's school was established w.e.f. 01.01.2000, in a remote area of Baksa district, after obtaining necessary permission as well as departmental recognition and the school was also verified by the District Level Redressal Committee, through the concerned Block Elementary Education Officer & Circle Officer, and on receipt of verification report, the District Level Redressal Committee, Baksa, has scrutinized all the relevant documents and on scrutiny, the school of the petitioner is found to be eligible for UDISE Code and recommended for allotment of UDISE Code. 4. Mr. Islam further submits that thereafter, the District Commissioner, Baksa, has issued an order dated 10.07.2024 recommending the school for allotment of UDISE Code for the year 2024-25 and forwarded the same to the Mission Director, SSA, Assam, but, till date no UDISE Code has been allotted to the petitioner's school. Mr. Islam further submits that the petitioner's school has already made online application for the UDISE Code, vide Annexure-10, but the said application has not been accepted by the respondent SSA. 5. In view of the above submission of the learned counsel for the petitioner, Mr. Choudhury, learned standing counsel for the respondent SSA was asked to obtain necessary instruction, as to why the online application of the petitioner's school was not accepted. Today, Mr. Choudhury, obtaining necessary instruction submits that the petitioner's school has applied for UDISE Code under the category 'Government Aided', but, the same ought to have been under the category 'Management', as the 'Government Aided' category has already been stopped by the authority and he further submits that in the event of of applying again by the petitioner's school through the District Mission Coordinator, SSA, Baksa, under the appropriate category, the respondent authority will
Page No.# 4/4 consider the same. Therefore, Mr. Choudhury has contended to issue direction to the petitioner's school to apply again for the UDISE Code. 6.
On such assurance, being given by Mr. Choudhury, learned standing counsel for the respondent SSA, Mr. Islam, learned counsel for the petitioner submits that the petitioner's school will again apply for UDISE Code through the District Mission Coordinator, SSA, Baksa, under the appropriate category. 7. Thus, taking note of the submission of learned counsel for both the parties and also considering the facts and circumstances on the record, this Court is inclined to dispose of this petition by directing the petitioner's school to apply for UDISE Code again through the District Mission Coordinator within a period of 2(two) weeks from today, under the proper category and in the event of such application being filed online, by the petitioner's school, the respondent Nos.4, 5, 6 and 8 shall consider the same in accordance with law. 8. The aforesaid exercise be carried out within a period of 3(three) weeks from the date of receipt of certified copy of this order. The petitioner's school shall obtain a certified copy of this order and place the same before the respondent authority within a period of one week from today. 9. In terms of above, this writ petition stands disposed of. Comparing Assistant Sd/- Robin Phukan JUDGE
