Short counter affidavit filed by learned counsel for the applicant is taken on record. 2. Heard learned counsel for the applicant and learned A.G.A. for the State. 3. The present application is filed with the prayer to quash the impugned order dated 29.10.2025 passed by the Court of learned Sessions Judge, Lucknow in Crl. Misc. Case No.4765 of 2025 and transfer the proceedings of S.T. No.985 of 2018 arising out of Case Crime No.109/2016 under Sections 342, 366, 376 I.P.C. and Section 66 I.T. Act, Police Station - Mahanagar, District - Lucknow. 4. Sri Vijay Dixit, Special Counsel for the High Court appeared on the request of this Court and on the basis of telephonic instructions received from the Presiding Officer informs that due to some cutting in the deposition of D.W.1, the page was changed with the consent of counsel for the parties. 5. On perusal of the contents of the pleadings as well as other relevant material it reveals that documents filed by the defence counsel alongwith Fehrist was considered at the time of examination- in-chief of the D.W.1 as there was cutting in the deposition, thereafter, fair statement was recorded by transcribing the same on a Versus Counsel for Applicant(s) : Prateek Tewari, Raj Nath Singh Counsel for Opposite Party(s) : G.A. Learned counsel for the parties has no objection, in case, the case is transferred to the Sessions Judge, Lucknow for final hearing. 7. Accordingly, in view of the above, the present application is disposed of and impugned proceeding is hereby set aside. 8. The Sessions Judge, Lucknow is directed to hear the matter and decide the same expeditiously. 9. Addl.
