No. - 1208 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. 1.The present anticipatory bail application has been filed seeking anticipatory bail in case crime No.58 of 2017 under sections 3/5ka/8 of Prevention of Cow Slaughter Act, P.S. Dhaurahra, district Lakhimpur Kheri. 2.Heard learned counsel for the applicant and learned Additional Government Advocate for the State. 3.A perusal of the record shows that charg sheet was filed way back in the year 2017. Cognizance has been taken on 29.8.2017. Since then, the trial is pending. The applicant appears to be absconding and not cooperating in the trial. 4.Learned counsel for the applicant submits that the applicant was not aware about the pending trial which does not appear to be true as there is no pleading in that regard that summon has been received by the applicant recently and he was not having any knowledge about the pending investigation. 5.Learned court below while rejecting the bail application has noticed these facts. Prima facie, it appears that after thorough investigation, charge sheet has been filed and the applicant is absconding. Home And Another .....Opposite Party(s) सहअिभयुǘ के िवɴǪ जुमă अęतगăत धारा-3/5क/8 गोवध िनवारण अिधिनयम मȅ पूरक आरोप-पś Šेिषत िकया गया है. िजसका संXान िदनांक 29.08.17 को अवर ęयायालय DZारा िलया जा चुका है। Šकरण सĞबिęधत ęयायालय मȅ िवचाराधीन है। Šाथȃगण / अिभयुǘगण अभी तक ęयायालय के समW उपिĥथत नहȂ आये है। Šथम सूचना िरपोटă मȅ मौके से कु ल 35 गोवंशीय पशु कटे ɷए िमले है और मांस को एक ĥथान पर इकǜा िकया जा रहा था, 15-20 Dzिǘयȋ DZारा जानवरो को िगरा कर काटने और खाल उतारने तथा पुिलस DZारा दिबश िदये जाने पर मौके से भाग जाने का उġलेख है। िववेचक DZारा दौरान िववेचना मौिखक एवं अिभलेखीय साĨय का संकलन िकया गया है और िवĥतृत िववेचना के उपराęत आरोप-पś Šेिषत िकया गया है। विणत तĖयȋ एवं पिरिĥथितयȋ तथा Šाथȃगण / अिभयुǘगण पर लगाये गये अिभयोग की Šकृ ित व गĞभीरता को देखते ɷये ęयायालय की राय मȅ अिŎम जमानत Šाथăना पś खािरज िकये जाने योĈय है। 6.In view of the above, since the applicant has failed to explain as to why he has filed anticipatory bail application after approximately eight years from the date when cognizance was taken by the court below, this court is not inclined to enlarge the applicant on anticipatory bail. 7.The applicant is accordingly dismissed.
