As per ofÏce report dated 11.04.2025, it transpires that the present appeal is stated to be not maintainable as the impugned order dated 18.03.2025 has been passed by the learned Additional Session Judge, Patthalgaon, District Jashpur (C.G.) and the objection has also been raised by the learned State counsel that in view of the provisions contained in Section 14A(2) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, the bail application ought to have been filed before the learned Special Judge (SC/ST) Act, to which learned counsel for the petitioner seeks permission of this Court to withdraw the present appeal with a liberty to file afresh before the appropriate forum. 4. Learned State counsel has no objection. 5. In view of the submission made by the learned counsel for the petitioner, the present appeal is dismissed as withdrawn with the aforesaid liberty, as prayed for.
