Heard the learned counsel appearing for the parties. 3. FIR in Crime No.18/2025 was registered by Bettadapura Police Station, Mysuru District against four persons, on the basis of first information dated 30.01.2025 received from Sri Sachin H.R S/o Ravi, who allegedly is one of the victim in the present case. During the course of investigation of the case, the petitioner herein was arrested and remanded to judicial custody on 01.02.2025. 4. The bail application filed by the petitioner before the jurisdictional Sessions Court in Crl.Misc.No.5030/2025 was dismissed on 11.02.2025. Perusal of the material on record would go to show that, in the first information specific overt acts are alleged against four persons as against whom FIR has been registered. The presence of fifth person in the spot of incident is not mentioned in the FIR. The petitioner who is now arrested has been arraigned as accused No.5 in the present case and has been remanded to judicial custody. Even in the remand application, the role of the petitioner has not been specifically stated. The petitioner has no other criminal antecedents. Under these circumstances, I am of the opinion that, the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. 6. Accordingly, the following: ORDER The petitioner is directed to be enlarged on bail in Crime No.18/2025 registered by Bettadapura Police Station, Mysuru District for the offences punishable under Sections 115(2), 118(1), 109, 126(2), 324(2), 351(2) & - 4 - NC: 2025:KHC:9596 CRL.P No. 2313 of 2025 352 R/w 3(5) of the BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE NMS
