This Court had passed an order dated 07.07.2024 (Annexure No. 1 to the affidavit), wherein the applicant was permitted to withdraw the said Application No.180 of 2024 with liberty to file afresh at the appropriate stage. 2. Learned counsel for the applicant is unable to point out that just after three months, how the application is maintainable. The fact remains that just after three months from the date of order i.e. 07.07.2025, the application is filed and it is too early to give any direction after the aforesaid direction given by this Court. 3. Accordingly, the instant application is dismissed and it is open for the applicant to move an application after reasonable time, if the trial is not proceeding in the case.
