HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 7276 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, learned AGA and perused the record. None has appeared for the informant despite notice. 2. The applicant seeks enlargement on bail in FIR No.83 of 2025, under sections 64(2)(f), 351(3), 352 BNS, Sections 5(N)/6 POCSO Act, Section 67(b) IT Act, P.S. Aaspur Devsara, District Pratapgarh. 3. Learned counsel for the applicant argues that in terms of FIR it was alleged that on 15.2.2025 daughter of informant was alone at home when the applicant came and committed wrong on her and also made video and thereafter threats were also issued. In the light of said allegations learned counsel for the applicant draws my attention to statement under Section 180 BNSS wherein the victim stated that on the date of incident i.e. 15.2.2025 the applicant had committed wrong on her. The tentative age of victim is around 17 years. Medical on record does not indicate presence of any injury. There is sufficient delay in lodging the FIR. The recovery of phone does not indicate presence of any video as alleged. 4. Learned AGA has opposed the bail application. 5. Considering the age of the victim which is around 17 years and delay in lodging FIR and the medical not corroborating the offence, however, without commenting upon the merits of the case, the applicant who is in jail since 1.4.2025 and has no criminal history is entitled to be enlarged Versus Counsel for Applicant(s) : Shanker Lal Pandey Counsel for Opposite Party(s) : G.A.
