2. This first bail application has been moved by the applicant seeking regular bail in F.I.R. No.113 of 2025, under Sections 376 I.P.C. and Section 3(2)(v) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, registered at Police Station Doiwala, District Dehradun.
3. An F.I.R. was lodged on 28.04.2025, wherein the complainant has alleged that, on the false pretext of getting married, the applicant have continuously committed sexual assault on her.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case and has no previous criminal antecedents. It is further submitted that the applicant has been in judicial custody since
27.05.2025. Learned counsel contends that both the complainant and the victim are major; the complainant is aged about 29 years, whereas the applicant is aged about 30 years. It is stated that they were in a consensual relationship for more than seven years. This fact finds
2025:UHC:10607 corroboration from the statement of the victim recorded under Section 164 of the Code of Criminal Procedure before the Magistrate.
Learned counsel for the applicant placed reliance on the
judgment rendered in the cases of Samadhan Vs. State of Maharashtra and another, reported in 2025 SCC OnLine SC 2528 and Mahesh Damu Khare Vs. State of Maharashtra, reported in (2024) 11 SCC 398.
5. Per contra, learned State Counsel vehemently opposed the bail application and would submit that the offence alleged is of a grave and heinous nature.
6. Considering the submission of
learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail at this stage.
7. The bail application is allowed.
8. Let the applicant, namely, Ravindra Singh be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
