HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 12430 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. In the prosecution case, it is alleged that the accused on the basis of forged certificates have appeared in the counseling of 2023 and have taken admission in the session 2023-24 in the College of Nursing in Rajarshi Dasharath Autonomous State Medical College, Ayodhya. Learned counsel for the applicant submits that the applicant is student. Role assigned to the applicant is similar to that of co-accused Sachin Rajvanshi, who has been enlarged on bail by this Court vide order dated 01.08.2024. Offences are triable by magistrate. The applicant has no criminal antecedents. The applicant has been languishing in jail since 01.10.2025. It is further submitted that there is no possibility of the applicants of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant. On due consideration to the order of co-accused Sachin Rajvanshi, so also the fact that offences are triable by magistrate, coupled with the fact that the applicant has been languishing in jail since 01.10.2025 without having any criminal history and without expressing any opinion on the merits of the case, I find it to be a fit case for enlarging the applicant on bail on parity.
