The present writ petition (criminal) under Article 226 of the Constitution of India filed on behalf of the Petitioner, Lokesh Kumar S/o Ranveer Singh against the Respondents in particularly Respondent no.3, Nasrin D/o Noor Hasan, who is the complainant; the present writ petition comes with the prayer to quash the F.I.R. dated 24.09.2025 lodged by the Respondent no.3 registered as Case Crime No.319 of 2025, for the offence punishable under Sections 351(2), 352 & 69 of BNS, registered at P.S. Bhagwanpur, District Haridwar and further to direct the Respondent nos.1 & 2 not to arrest the Petitioner in connection with the abovementioned FIR. 5. Heard. 6. Admit. 7. As per the FIR, there are serious allegations against the Petitioner by the Respondent no.3/complainant (victim), wherein it is said that the Petitioner on the pretext of getting her job had physically exploited her. 8. Now at this juncture, Compounding Application (IA No.01 of 2025) is also annexed with the present writ petition that is supported with the affidavits of the parties and the said application is being endorsed by the learned counsel for the 2025:UHC:11175 Petitioner and Respondent no.3, Mr. Amit Kapri, Advocate and Mr. Deep Prakash Bhatt, Advocate respectively. 9. The parties are present before this Court, who are identified by their respective counsel. 10. After interacting with the parties especially with Respondent no.3, Nasrin D/o Noor Hasan (complainant), she makes a statement that due to some misunderstanding, the Respondent no.3 lodged the present FIR against the Petitioner and now the parties have amicably settled their dispute and Respondent No.3 has no grievance or complaint remaining against the Petitioner, therefore, the proceedings and other consequential order arising out of the impugned F.I.R./Case Crime Number in question may be quashed. 11. The said compounding application is strongly opposed by the learned State counsel on the ground that one of the offences is non-compoundable. 12. In view of the principle of law laid down by Hon'ble the Apex Court in the case of “Gian Singh vs. State of Punjab” reported in 2012 (10) SCC 303 as well as in Transfer Petition (Criminal) No. 115 of 2012 (Dimpey Gujral vs. Union Territory of Chandigarh) decided on 06.12.2012, criminal proceedings can be quashed by this Court, if this Court is satisfied with the facts and circumstances of the case. 13. Keeping in view of the totality of the facts and circumstances of the case, this Court is of the view that ends of justice would be met, if the entire proceedings against qua the Petitioners are hereby quashed. 14. In view of the above, the compounding application is allowed. The F.I.R. dated 24.09.2025 lodged by the Respondent no.3 registered as Case Crime No.319 of 2025, 2025:UHC:11175 for the offence punishable under Sections 351(2), 352 & 69 of BNS, registered at P.S. Bhagwanpur, District Haridwar, is hereby quashed. 15. The present writ petition (criminal) under Article 226 of the Constitution of India is, thus, disposed of in terms of the compromise arrived at between the parties.
