HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. WRIT PETITION No. - 9823 of 2024 Court No. - 10 HON'BLE RAJNISH KUMAR, J.
HON'BLE ZAFEER AHMAD, J.
1. Case called out. 2. None for the petitioners to press the petition. 3. This Court had passed the following order on 20.12.2024:
"1. Heard. 2. By means of this petition, the petitioners, Rangi Lal, Sukh Ram, Hari Ram, Kshatrapaal, Lal Ji, have sought quashing of First Information Report dated 03.12.2024 bearing F.I.R. No. 0575 of 2024, under Sections 333, 74, 76, 351 (3) of B.N.S., 2023 and Section 7/8 POCSO Act, registered at Police Station Ramgaon, District Bahraich. 3. The contention of the learned Counsel for the petitioners is that the petitioners have falsely implicated in the impugned F.I.R. According to the petitioners, on 23.07.2021, petitioner no.5-Lal Ji has lodged an F.I.R. against nephew of the opposite party no.4, which is at the stage of evidence and for the said reason, as a counter-blast and in order to put pressure upon the petitioners, impugned F.I.R. has been lodged by the complainant/opposite party no.4 levelling absolutely vague allegations. He states that no such incident as alleged in the impugned F.I.R. has ever occurred, hence petitioners pray for protection. 4. On due consideration, prima facie, a case for consideration is made out. 5. Issue notice to the opposite party no.4. Steps be taken within a week. 6. Office will submit service report on the basis of computerized tracking report. 7. Let counter affidavit be filed within two weeks. Rejoinder affidavit may be filed within two weeks thereafter. 8. List after four weeks. Versus Counsel for Petitioner(s) : Gyanendra Pathak Counsel for Respondent(s) : G.A. Rangi Lal And Others .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And Others .....Respondent(s)
9. Considering the submissions made, it is provided that till the next date of listing, the petitioners shall not be arrested on the basis of the impugned First Information Report, unless sufficient and credible evidence is available against them. The petitioners shall, however, cooperate in the investigation and get their statement recorded before the Investigating Officer as and when they are called. If they do not do so then it can be made a ground for seeking vacation of this interim order."
3.
Learned AGA on the basis of counter affidavit filed today which is taken on record, submits that after exclusion of Section 333, 74, 76 BNSS and 7/8 POCSO Act, Charge Sheet No. 577/2024 dated 2.12.2024 under Section 115(2), 352, 351(3) BNSS has been forwarded against Rangi Lal, petitioner no. 1 and the names of other petitioners, namely, petitioners no. 2, 3, 4 and 5 have been dropped, thus the petition has lost its efficacy. 4. Dismissed accordingly. November 7, 2025 Fahim/- CRLP No. 9823 of 2024 2 (Zafeer Ahmad,J.) (Rajnish Kumar,J.)
