This application has been filed with the following prayer:- "To quash the entire proceedings of Session Trial No.1196/2022, State Versus Om Prakash @ Vakeel, in Charge Sheet no. A-130/2022 dated 19.5.2022 filed in Case Crime no. 490/2021, U/S-302 I.P.C, P.S.- Para, District- Lucknow, pending before learned Special Judge-II, P.C. Act, District- Lucknow." 4. The applicant is present today before this Court in pursuance of earlier order. 5. It is evident from the record that 14 witnesses have already been examined before the trial Court and the trial is going on. Therefore, at this stage, the application u/s 528 B.N.S.S. cannot be entertained for setting aside the entire trial of the case in question by way of examining the evidence collected by the Investigating Officer as well as deposition of the witnesses. 6. With the above observations, the present application, being misconceived, is dismissed.
