Instant MCC under Order 44 Rule 1 of the CPC has been preferred by the applicant seeking permission to file first appeal as ‘indigent person’. 2 2. In pursuance of the order dated 09.07.2025 passed by this Court, Collector, Raipur has sent a report with regard to financial status and income of the applicant, in which, it has been reported that husband of applicant is Labourer, their financial condition is very poor, only labour work is their source of income and their total annual income is Rs. 38,000/- . 3. On due consideration of aforesaid report submitted by the Collector, Raipur, I feel inclined to allow this MCC filed by the applicant/plaintiff under Order 44 Rule 1 of the CPC and she is permitted to file first appeal as an ‘indigent person’ subject to condition that in the event of granting decree in favour of plaintiff / proposed appellant, the court fees payable for the instant appeal shall be adjusted from the decree granted in her favour. 4. In view of aforesaid observation & direction, this M.C.C. is allowed. Registry is directed to register first appeal and list this case accordingly for hearing & disposal in accordance with law.
