Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite party no.1 while power on behalf of opposite parties 2 and 3 has been fled by Mr. Jayesh Bhoosreddy, Advocate which is taken on record. 2. Present petition under Article 226 of Constitution of India has been filed seeking a direction to opposite parties for recompute and release gratuity in terms of Payment of Gratuity Act, 1972[hereinafter referred to as the Act of 1972] by taking into account the service rendered by petitioner from the date of his initial appointment, for purpose of computation of such gratuity. Interest on withheld/delayed gratuity in accordance with Section 7(3A) of the Act of 1972 has also been sought. 3. Since considering petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file fresh representation before opposite party no.2 i.e. Director, Rajya Krishi Utpadan Mandi Parishad U.P., Lucknow. In case such a representation is filed, the same is required to be decided by authority concerned expeditiously by a reasoned and speaking order within a period of six weeks from receipt of representation of petitioner along with a certified copy of this order.
