CMP No.1440 of 2026 The present application under Section 151 of CPC, has been filed on behalf of respondents No.2 & 3, for modification of order dated 26.11.2025, passed by this court in CMP No.27912 of 2025. Heard. Since two Insurance Companies have been fastened with the liability to pay award amount to respondents No.1 to 6 in equal proportions and only the present appellant, i.e. National Insurance Company, had preferred the appeal against the award dated 29.08.2025 and other Insurance Company, which has been arrayed as respondent No.10, had not preferred any appeal, therefore, order dated 26.11.2025, is modified only to the extent that the operation and execution of impugned award dated 29.08.2025, passed by learned Motor Accident Claims Tribunal-II, Mandi, District Mandi, H.P. in Claim Petition No.26 of 2021, shall remain stayed only qua the present appellant, i.e. National Insurance Company Limited and not qua respondent No.10, i.e. HDFC, Ergo General Insurance Company Limited. The claimants are at liberty to get the judgment of learned tribunal below executed in accordance with law against HDFC, Ergo General Insurance Company Limited. Application stands disposed of.
