Petitioner’s claim for re-employment as outsourced employee has been rejected on the ground that now there is no vacancy left. Petitioner contends that since he served for nearly 12 years upto 2023, therefore, his case is covered by the Regularisation Rules, therefore, he has earned a right to be considered for regularisation. 5. Learned State Counsel concedes that although Regularisation Rules have been amended by a notification dated 5.12.2025, however, it is debatable whether petitioner’s case would be covered by the Regularisation Rules or not. 2025:UHC:11270 6. Without expressing any opinion on the merits of the case, the writ petition is disposed of by providing that if petitioner is eligible to be considered under the Regularisation Rules, as amended vide notification dated 5.12.2025, then his claim shall also be considered while undertaking regularisation exercise. It shall be open to the petitioner to make representation as and when process of regularisation is undertaken.
