05/ 12.08.2025: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Shikaripara P.S. Case No. 55 of 2024, registered under sections 379/341/342/323/307/353/34 of I.P.C., pending in the Court of learned Additional Chief Judicial Magistrate, Dumka.

Learned counsel for the petitioner submits that the petitioner is a driver of truck in question and allegation is made that illegally excavation of sand was being carried. He submits that owner of the said vehicle has been granted anticipatory bail in A.B.A. No. 6242 of 2024. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegation of illegal excavation of sand is there.

Considering that petitioner is a driver of truck in question and owner of the said vehicle has been granted anticipatory bail in A.B.A. No. 6242 of 2024, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Dumka, in connection with Shikaripara P.S. Case No. 55 of 2024, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
