The present petition filed under Section 438 read with Section 442 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 397 and Section 401 of the Code of Criminal Procedure, 1973, respectively) impugns order dated 17th April, 2021 passed by the Family Court, South West, Dwarka directing the Petitioner herein to pay a sum of INR 19,600/- per month to Respondents No. 2 and 3 as interim maintenance from the date of filing of the application till disposal of the petition. 2. During the course of proceedings, parties have arrived at a settlement This is a digitally signed order. The Order is downloaded from the DHC Server on 02/05/2025 at 12:13:42 before the Delhi High Court Mediation and Conciliation Centre and executed a Settlement Agreement dated 22nd October, 2024, copy whereof has been placed on record. 3. Both Petitioner and Respondent No. 2 have joined the proceedings through video conferencing mechanism and confirmed the factum of settlement. The Petitioner also states that he has no objection to the disbursal of the fixed deposit along with accrued interest in favour of Respondent No.2. 4. In terms of the afore-noted settlement, no further directions are required to be issued in the present petition. 5. Accordingly, the present petition is disposed of with a direction to the Registry to release the FDR as well as the lien thereon. Once the FDR is released, Petitioner shall transmit the amount of FDR along with accrued interest in favour of Respondent No. 2. 6. List for compliance on 22nd May, 2025.
