It has been submitted that due to typographical error the last name of the petitioner has been typed as Tripath in the memo of the petition as well as in affidavit while it should be Tripathi. 3. The application is allowed. Let the correction/amendment be carried out during course of the day. order on memo. 1. Heard learned counsel for the petitioner as well as learned Standing Counsel for the State respondent. 2. In view of the order proposed to be passed, notice to private respondents is dispensed with. 3. Instant petition has been filed by the petitioner praying for direction to respondent No.1 i.e. Tehsildar Mankapur, Tehsil Mankapur, District Gonda to decide application for recall/restoration dated 17.4.2025 filed by the petitioner in case NO.5989/2024 (computerized case No.T202408300705989 "Sunil Kumar Tripathi Vs. Dinesh Kumar" under Section 34/35 of U.P. Revenue Code, expeditiously within the time specified by this Hon'ble Court in the interest of justice. 4. Learned counsel for the petitioner submits that grievance of the petitioner would be Versus Counsel for Petitioner(s) : Vijay Pal Verma Counsel for Respondent(s) : C.S.C. Sunil Kumar Tripathi .....Petitioner(s) Tehsildar Mankapur, Tehsil Mankapur, Gonda And Others .....Respondent(s) sufficiently met in case Tehsildar Mankapur, Tehsil Mankapur, District Gonda considers and decides the aforesaid case in the time bound manner. 5. Learned Standing Counsel has no objection to the aforesaid prayer. 6. Considering the facts and circumstances of the case, without entering into the merits, Tehsildar Mankapur, Tehsil Mankapur, District Gonda is directed to decide application for recall/restoration dated 17.4.2025 filed by the petitioner in case NO.5989/2024 (computerized case No.T202408300705989 "Sunil Kumar Tripathi Vs. Dinesh Kumar" under Section 34/35 of U.P. Revenue Code, expeditiously, say within a period of four months from the date of production of certified copy of this order, after affording opportunity of hearing to the parties concerned in accordance with law, if there is no legal impediment. 7. It is further directed that the parties to the case shall cooperate in expeditious disposal of the case and shall not seek any unnecessary adjournment, neither any such adjournment shall be granted by the Court concerned, except in exceptional circumstances. Counsel for the petitioner undertakes that he shall cooperate in expeditious disposal of the case, failing which the benefit of this order shall not be available to the petitioner. 8.
