Raghunandan Rao) The 2nd respondent, in the Writ Appeal, had purchased an extent of Ac.9.01 cents of land in RS.No.300 of Kavuluru Village, G. Konduru Mandal of Krishna District, by way of deed of sale, dated 18.03.2011, executed by the 1st respondent, in the Writ Appeal. The Registration Authorities, upon presentation of the said document, refused to register the same on the ground that the said land belongs to the appellant-temple and that the said land was Endowment land, which cannot be registered. Aggrieved by this refusal to register, the respondents 1 & 2, in the Writ Appeal, approached this Court, by way of W.P.No.2625 of 2013. A learned Single Judge of this Court, by an order, dated 12.08.2013, had allowed the Writ Petition, with a direction to the Sub-Registrar, Ibrahimpatnam, Vijayawada, to register and release the documents presented by the petitioners therein (respondents 1 & 2 in the Writ Appeal) if it is found otherwise, to fulfil the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, without reference to the letter that is said to have been sent by the Endowment Authorities. 2. Aggrieved by this order of the learned Single Judge, the appellant-temple has filed the present Writ Appeal. 3. Sri T.V.P. Sai Vihari, learned counsel for the respondents 1 & 2 submits that the said document had been received and registered by the Sub-Registrar, Ibrahimpatnam and the document has also been released in 5 RRR, J & TCDS, J W.A.No.318 of 2014 & C.R.P.No.4565 of 2014 favour of the 2nd respondent herein. He would further submit that the appellant had moved O.A.No.771 of 2014, before the Endowment Tribunal, contending that the land belongs to the appellant-temple and for setting aside the deed of sale executed by the 1st respondent in favour of the 2nd respondent. This Original Application (O.A.) is still pending before the Tribunal. 4. The issue in the present case revolves around the ownership of the land in question. The said question is before the Endowments Tribunal, which would be the competent body to decide the question of title. 5. In such circumstances, this Writ Appeal is disposed of, with a direction to the Endowments Tribunal to dispose of O.A.No.771 of 2014, at the earliest and preferably within a period of six (06) months from the date of receipt of this order. The validity of the deed of sale, dated 18.03.2011, which is the subject matter of the O.A.No.771 of 2014, before the Endowments Tribunal, shall be determined in accordance with the findings and directions of the Tribunal. 6. It also appears that the Endowments Tribunal had directed payment of rent by the 2nd respondent, in the O.A., during the pendecy of the Application and the respondents therein had moved this Court, by way of C.R.P.No.4565 of 2014. This Court, by an interim order, dated 12.12.2014, had suspended the order of the Endowments Tribunal, requiring payment of rent by the respondents in the O.A. 6 RRR, J & TCDS, J W.A.No.318 of 2014 & C.R.P.No.4565 of 2014 7. In view of the disposal of the Writ Appeal, it would be appropriate to dispose of the Civil Revision Petition also, with a direction that the payment of rent, if any, found by the Tribunal, would be part of the rent or damages that the Tribunal may determine in the final order. 8. Accordingly, both the Writ Appeal and the Civil Revision Petition are disposed of. There shall be no order as to costs. As a sequel, interlocutory applications pending, if any shall stand closed. ________________________ R.
