3. The gist of allegation in this case is that pursuant to a romantic relationship accused lured by the informant with false promise of marriage thereafter, physical relationship was entered into with her. But, subsequently, the accused did not marry her and the informant also came to know that now he has married another woman.
4. It is submitted that on the basis of consensual relationship, no offence is made of and he is in custody for several days. In support of his contention,
learned counsel for the petitioner has placed before the court the decision of the Hon’ble Apex Court in Ravish Singh Rana vs State of Uttarakhand and another reported in Criminal Appeal No. 2438 of 2025 and drawn my attention to paragraph 13 to 16 thereof. In the said decision, the Hon’ble Apex Court was pleased to quash the proceeding after opining that it was a case of conscious relationship out of the love affair.
5. I have heard Mr. R. J. Baruah, learned Addl. Public Prosecutor who produced the case diary.
6. In the given facts and circumstances, prima facie it appears that the whole incident allegedly arose out of love affair and the subsequent refusal of the accused to marry the informant. Therefore, while the investigation continues, I am of the view that the accused should be granted bail at this stage.
7. Accordingly, the petitioner, named above, shall be released on bail on furnishing bail bond of Rs.20,000/- with one suitable surety of the like amount to the satisfaction of learned concerned court. The direction for bail is further subject to the conditions that the petitioner: (a) shall co-operate with investigation; (b) shall not in any manner cause any harm or harassment to the alleged
