Petitioner contends that a road has been constructed over her private land without paying any compensation. 3. The reliefs sought in the writ petition are as follow: “i Issue a writ, order or direction in the nature of mandamus commanding the respondents to forthwith initiate acquisition proceedings under the Right to Fair Compensation and Transparency in Land Acquisition Act, 2013 with respect to land of the petitioner which is shown in Khatauni (Annexure no. 1) and pay the due compensation as per law. ii. Issue a writ, order or direction in the nature of mandamus commanding the respondents to consider and decide the representation dated 23.07.2025 (Annexure no. 4) of the petitioner in a time bound manner by a speaking and reasoned order.” 4. Learned State Counsel, however, on instructions submits that 60 feet wide road was built over the site at Chaibagan, Kolagarh, Dehradun sometimes before 1964 and the said road is now being maintained by Nagar Nigam, Dehradun and not by Public Works Department. He further submits that now there is no further 2025:UHC:11341 proposal to widen that road and the apprehension expressed by petitioner, that her property is likely to be disturbed, is unfounded. 5. Learned counsel for petitioner, however, submits that the stand taken by respondents is not correct and her bhumidhari land has been taken for construction of road, without paying any compensation. 6. Without going into the matter any further, this Court thinks that if petitioner has any grievance in the matter, then she can approach the competent authority by making representation. 7. The writ petition is, accordingly, disposed of with liberty to petitioner to make representation to the competent authority. If petitioner makes such representation within two weeks from today, decision thereupon shall be taken, as per law, within six months thereafter.
