Sri Prem Chandra Patel, learned counsel for the applicant, Shri Chhavi Pal Singh, learned A.G.A. for the State and perused the material on record. The present application under Section 528 of the B.N.S.S has been filed to quash the order dated 6.11.2023 passed by Additional Principal Judge, Family Court No. 1, Jaunpur in Maintenance Case No. 174 of 2016, arising out of an application under Section 125 of Cr.P.C. as well as order dated 2.1.2025 passed by Additional Principal Judge, Family Court No. 1, Jaunpur in Execution Case No. 2780 of 2023, arising out of an application under Section 128 of Cr.P.C. whereby attachment of property has been issued to recover the arrears of maintenance amount against the applicant. As per instructions of the concerned court, no recovery warrant has been issued against the applicant, but recovery certificate through District Magistrate has been issued as per impugned order. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction. The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
