PUBLIC PROSECUTOR The Court made the following: ORDER:- The Criminal Petition has been filed under 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioners/Accused Nos.1 to 3 for granting of pre-arrest bail in connection with Crime No.35 of 2025 of GD Nellore Urban Police Station, Chittoor District registered for the alleged offences punishable under Sections 74, 118(1), 115(2) r/w 3(5) of BNSS. 2. Facts, in brief, of the case are that on 22.03.2025, at about 2.00 pm., the de facto complainant lodged a report before the police officials stating that Accused Nos.1 to 3 beat the complainant and his wife with stick and caused bleeding injuries. Based on the report, the Station House Officer, GD Nellore UPS, Chittoor registered a case in Crime No.35 of 2025 and investigated into. 3. Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. 4. Sri D.Purnachandra Reddy, learned counsel for the petitioners submits that the Petitioner No.2/Accused No.2 is aged about 75 years and Petitioner No.3/Accused No.3 is aged about 72 years and the allegations attributed against them are false. The petitioners would abide by any condition to be imposed by this Court. 5. Per contra, Mr.Neelothpal Ganji, the learned Assistant Public Prosecutor, opposed in granting of bail stating that the injured sustained serious injuries and the investigation is pending. In view of the nature of the allegations leveled against the Petitioner Nos.2 and 3, who are about 75 years and 72 years old respectively and their alleged role played in this case, this Court is inclined to consider 6. request of petitioner Nos.2 and 3 for grant of anticipatory bail. Accordingly, this Criminal Petition is partly allowed in so far as Petitioner Nos.2 and 3 are concerned, with the following directions: 7. S. In the event of arrest of the Petitioner Nos.2 and 3, the Petitioner Nos.2 a) and 3 shall be enlarged on bail on executing a personal bond for a sum of Rs. 10,000/- (Rupees ten thousand only) each, with two sureties each for the, like sum each to the satisfaction of the arresting police officials; b) The Petitioner Nos.2 and 3 shall make themselves available for investigation as and when required; c) The Petitioner Nos.2 and 3 shall not cause any threat, inducement or promise to the prosecution witnesses; d) The Petitioner Nos.2 and 3 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 05.00 p.m., till filing of the charge sheet. e) The Petitioner Nos.2 and 3 shall not leave the district limits without the express permission from the Station House Officer concerned. 8.
