1. Heard Sri Amitesh Pratap Singh, learned counsel for petitioner as well as learned Standing Counsel for the State-respondents.

Tehsildar, Sirauli Gauspur, Barabanki) wherein on a revision preferred by respondent No. 2 and after hearing learned counsel for petitioner, the revision has been admitted for hearing and notices have been issued to other respondents.
4. Learned counsel for petitioner has submitted that the Board of Revenue has wrongly entertained the said revision despite the fact that the same was not admissible inasmuch an application for recall has been preferred by the petitioner against the order dated 11.07.2025 passed by Tehsildar.
5. Be that as it may, it is noticed that was the petitioner has put in appearance, he has right to oppose the maintainability of the proceedings pending before the Board of Revenue and further the Board of Revenue has full powers and jurisdiction to record any finding with regard to maintainability of the revision before it. 6. Accordingly, once the petitioner has put in appearance before Board of Revenue and he would be at liberty to raise all objections which would be duly considered and decided. This Court in the aforesaid circumstances, would not exercise extraordinary jurisdiction to hear the same issue in writ proceedings.
