A VARALAKSHMI The Court made the following: 2 COMMON ORDER: I.A.Nos.1 and 4 of 2020 This Criminal Petition is filed under Section 482 of Cr.P.C., seeking quash of proceedings against petitioner/accused No.1 in Crime No.367 of 2020 on the file of SHO PS Kadiyam, East Godavari District registered for the offences under Sections 417, 376 (2) (n), 312 r/w 34 IPC and Section 5 r/w 6 of POCSO Act, 2012. 2. Heard Mr. V Sai Kumar, learned counsel for the petitioner and Ms. A Varalakshmi, learned counsel for the de facto complainant. Learned Additional Public Prosecutor representing the State is present. 3. The de facto complainant filed I.A.Nos.1 and 4 of 2020, duly enclosing a Joint Memo, filed by the petitioner as well as de facto complainant, on 31.08.2020. It is stated that at the intervention of elders on both sides, the petitioner and the de facto complainant have arrived at an understanding, as per which the petitioner and the defacto-complainant got married and intend to withdraw the criminal case. In view of the same, the de facto complainant prayed to record the compromise and allow the criminal petition. 4. Today, when the matter is taken up, petitioner/accused No.1 and the de-facto complainant are present in person before this Court. The parties are identified by their respective counsels. 5. This Court has questioned the de-facto complainant with regard to the compromise and she categorically stated that she has voluntarily entered into 3 the compromise with the accused and has agreed to quash the present criminal petition against the petitioner herein. 6. This Court is satisfied with the identification of the parties and terms of the compromise. In view of the compromise arrived between the parties, the chances of conviction are remote and bleak. 7. In view of the compromise entered between the parties and the settlement in the interest of both petitioner and de-facto complainant, I find that this is a fit case to permit the petitioner to compound the offences. 8. Accordingly, I.A.Nos.1 and 4 of 2020, are ordered. Criminal Petition No.3666 of 2020 9. In view of the orders passed in I.A.Nos.1 and 4 of 2020 in Cr.L.P.No.3666 of 2020, the present criminal petition is allowed in terms of the joint memo dated 31.08.2020, by quashing the proceedings initiated against the petitioner/accused in Crime No.367 of 2020 on the file of SHO PS Kadiyam, East Godavari District. 10. Registry is directed to annex a copy of the Joint Memo filed along with I.A.No.4 of 2020 to this order.
