Mr. Shubhang Dobhal, Advocate, for the petitioner. Mr. N.S. Pundir, Deputy AG, for the State. (2) Petitioner was employed as Senior Assistant in the O/ o Sub Divisional Magistrate, Roorkee. He was selected for appointment as Inspector in Horticulture Department and he tendered resignation on 9.8.2024. His resignation was accepted by District Magistrate, Haridwar, vide order dated 8.10.2024. After acceptance of resignation, petitioner sought withdrawal of his resignation on 21.6.2025. His request for withdrawal was turned down. Thus feeling aggrieved, petitioner has approached this Court challenging the order dated 18.8.2025, whereby permission to withdraw the resignation was denied. (3) This Court do not find any reason to interfere in the matter. Law is well settled that resignation can be withdrawn, but only before its acceptance. It is not in dispute that the resignation was accepted on 8.10.2024 i.e. much before the request for withdrawal was made on 21.6.2025. (4) Learned Counsel for the petitioner relies upon para 3.3 of the Office Memorandum dated 24.11.2022, issued by Government of India, Ministry of Personnel, Public Grievances and Pensions, which provides for retention of lien in another Central Government office/ State Government office. The said clause would help a Central Government employee, who tenders technical resignation for joining another post in Central Government/ State Government, then he can hold lien for a 2025:UHC:11328 certain period. This is not the case here. Thus there is no scope for interferences. Writ petition fails and is dismissed.
