1. Heard learned counsel for the applicant, learned AGA and perused the record. None appears for the informant despite notice. 2. The applicant seeks enlargement on bail in FIR No.544 of 2025, under sections 127(2), 64(1) BNS, Sections 3/4 POCSO Act, P.S. Shahabad, District Hardoi. 3. Learned counsel for the applicant argues that in terms of FIR it was alleged that informant aged about 17 years had gone to her uncle's home on 14.8.2025 and when she came out of home the applicant caught hold of her and took her to his home and committed wrong on her and left her back at 4 in the morning. FIR was lodged on 15.8.2025 at about 8:40 PM. In the statement under Section 180 BNSS FIR version was reiterated. However in the statement under Section 183 BNSS the victim stated that she had left her home. Medical on record done on 16.8.2025 does not corroborate the allegations. There is no definite document with regard to exact age of the victim. 4. Learned AGA has opposed the bail application. 5. Considering the tentative age of the victim and the fact that the victim stayed with the applicant from 11 PM to 4 AM on his residence without raising hue and cry and medical on record not corroborating the allegations, however, without commenting upon the merits of the case, Versus Counsel for Applicant(s) : Raghunath Prasad Counsel for Opposite Party(s) : G.A.
