JUSTICE SANJAY KUMAR MEDHI ORDER 17.09.2025 Heard Shri G. N. Sahewalla, learned Senior Counsel assisted by Ms. K. Sarma, learned counsel for the petitioner. Also heard Shri N. Goswami, learned State Counsel as well as Ms. G. Hazarika, learned Standing Counsel, Revenue Department. The grievance of the petitioner is with regard to the inaction of the respondent authorities to comply with an order dated 13.11.2024 passed by the learned Addl. District Judge, Jorhat in a proceeding under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. By the said order, a direction was given to the respondent no. 2 to make a reference in terms of the said Act. The grievance of the petitioner is that the said order was not complied with in spite of the clear direction. When this matter had come up for consideration on the previous dates, namely, 20.08.2025 and 27.08.2025, the learned State Counsel was directed to obtain instructions with regard to the follow up action. Shri Goswami, the learned State Counsel has submitted that on 02.09.2025, the reference under Section 64 of the Act has indeed been made along with the documents to the competent authority. The learned counsel has also placed before this Court copy of the communication dated 02.09.2025. The learned Senior Counsel for the petitioner has submitted that though he does not have clear instructions on this issue, he has fairly submitted that in Page No.# 3/3 view of the aforesaid instructions, there may not be any further grievance to be espoused. In view of the above situation, this Court is of the opinion that there is no requirement to continue with this writ petition any further and accordingly the same is closed.
