PUBLIC PROSECUTOR The Court made the following Order: Heard learned counsel for the petitioner and learned Assistant Public t I Prosecutor appearing for the State. The learned counsel for the petitioner submits that the petitioner is aggrieved by the order passed in Crl.M.P.No.5417 of 2024 in C.C.No.148 of 2016 on the file of Judicial Magistrate of First Class, Kothavalasa. The petitioner is facing trial for alleged offence under Section 138 of N.I. Act. The petitioner has filed CrI.M.P., seeking leave of the Court to receive the 2. 2 documents relating to the order of promotion and training program of the petitioner covering the period from 21.12.2015 to 26.02.2016. The contention of the petitioner that the petitioner was not served with the statutory legal notice during that period as he was not available at the address mentioned in the cause title and that he was undergoing training on account of his promotion. The learned Magistrate has dismissed the petition vide order dated 05.03.2025. The paragraph 10 would clarify as to why the learned Magistrate has dismissed the petition. It is categorically held by the learned Magistrate that the petitioner had filed similar petitions since 14.12.2023 and that the present petition was another step towards dragging the matter relating to the year 2016. Under those circumstances, the petition was dismissed. 3. This Court finds no valid grounds to interfere with the well considered order of the learned Magistrate and accordingly, the Criminal 4.
